Data protection
Privacy Policy Europadesk GmbH
Controller and content of this privacy policy
Europadesk GmbH operates the website www.europadesk.ch and is, unless otherwise stated, responsible for the data processing listed in this privacy policy.
This privacy policy describes how your personal data is collected, used, and shared when you use www.europadesk.ch or shop in the webshop.
Our data protection practices are primarily based on the legal requirements of Swiss data protection law, particularly the Federal Act on Data Protection (FADP).
Please note that the following information will be reviewed and updated from time to time. We therefore recommend that you consult this privacy policy regularly. Furthermore, for individual data processing operations listed below, other companies are responsible for data protection or jointly responsible with us, so in these cases, the information provided by these providers is also decisive.
Contact person for data protection
If you have any questions about data protection or wish to exercise your rights, please contact us by email at: info@europadesk.ch
Your rights
Provided that the legal requirements are met, you, as a data subject, have the following rights:
-
You have the right to request access to your personal data stored with us at any time, free of charge, if we process it. This gives you the opportunity to check what personal data we process about you and that we use it in accordance with applicable data protection regulations.
-
You have the right to have inaccurate or incomplete personal data corrected and to be informed about the correction. In this case, we will inform the recipients of the data concerned about the adjustments made, unless this is impossible or involves disproportionate effort.
-
You have the right to have your personal data deleted under certain circumstances. In individual cases, particularly in the case of statutory retention obligations, the right to deletion may be excluded. In such a case, under given conditions, data blocking may replace deletion.
-
You have the right to request that the processing of your personal data be restricted.
-
You have the right to receive the personal data you have provided to us free of charge in a readable format.
-
You can object to data processing at any time, especially for data processing related to direct marketing (e.g., newsletters).
-
You generally have the right to withdraw any consent given at any time. However, processing activities previously based on your consent will not become unlawful due to your withdrawal.
To exercise these rights, please send us an email to the following address:
You have the right to lodge a complaint with a competent supervisory authority, e.g., regarding the manner in which your personal data is processed.
Data Security
We employ appropriate technical and organizational security measures to protect your personal data stored with us against loss and unlawful processing, particularly unauthorized access by third parties. Our employees and the service providers commissioned by us are obliged by us to maintain confidentiality and data protection. Furthermore, these persons are granted access to personal data only to the extent necessary for the fulfillment of their tasks.
Our security measures are continuously adapted in line with technological developments. However, the transmission of information over the internet and electronic communication channels always entails certain security risks, and we cannot guarantee absolute security for information transmitted in this way.
Contacting us
When you contact us via our contact addresses and channels (e.g., by email, telephone, or contact form), your personal data will be processed. The data you have provided to us will be processed, e.g., your company name, your name, your function, your email address or telephone number, and your request. In addition, the time of receipt of the request is documented. Mandatory fields in contact forms are marked with an asterisk (*).
We process this data exclusively to fulfill your request (e.g., providing information about a product, assisting with contract processing such as returning products, incorporating your feedback into the improvement of our services).
Use of your data for marketing purposes
Central data storage and analysis in the CRM system (Customer Relationship Management system)
If a clear assignment to your person is possible, the data described in this privacy policy, i.e., in particular:
-
Personal details
-
Contacts
-
Your contract data
-
Browsing behavior
on our websites are stored and linked in a central database. This serves the efficient management of customer data and allows us to adequately respond to your requests and enables the efficient provision of the services you desire and the processing of related contracts.
This data is evaluated to further develop our offers in a needs-oriented manner and to display and suggest the most relevant information and offers to you. We also use methods that predict potential interests and future orders based on your website usage.
Email marketing and newsletters
If you register for our email newsletter (e.g., when opening or within your customer account), your email address will be stored. Mandatory fields are marked with an asterisk (*) in the registration form.
To prevent misuse and to ensure that the owner of an email address has actually given their consent, we use a so-called double opt-in for registration for non-identifiable customers. In this case, after submitting the registration, you will receive an email from us containing a confirmation link. To definitively subscribe to the newsletter, you must click this link. If you do not click the confirmation link within the specified period, your data will be deleted again and our newsletter will not be sent to this address.
By registering, you consent to the processing of this data to receive messages from us about our company, our offers, and related products and services. This may also include behavior-based or personalized content as well as invitations to participate in competitions or to rate one of the aforementioned products and services. The collection of the email address allows us to verify the assignment of the registration to an existing customer number. Linking with a customer account helps us to make the offers and content in the newsletter more relevant to you and to better tailor them to your potential needs.
We will use your data for email dispatch until you withdraw your consent. Withdrawal is possible at any time.
Our marketing emails may contain a so-called web beacon or 1x1 pixel (tracking pixel) or similar technical aids. A web beacon is an invisible graphic linked to the user ID of the respective newsletter subscriber. For each marketing email sent, we receive information about which addresses have not yet received the email, to which addresses it was sent, and for which addresses the delivery failed. It also shows which addresses have opened the email and which links they have clicked. Finally, we also receive information about which addresses have unsubscribed. We use this data for statistical purposes and to optimize marketing emails in terms of frequency, timing, structure, and content of the emails. This allows us to better tailor the information and offers in our emails to the individual interests of the recipients.
The web beacon will be deleted when you delete the email. To prevent the use of web beacons in our marketing emails, please adjust the parameters of your email program so that HTML is not displayed in messages, if this is not already the default setting. You can find information on how to configure this setting in the help sections of your email software.
By subscribing to the newsletter, you also consent to the statistical evaluation of user behavior for the purpose of optimizing and adapting the newsletter.
We use Shopify's email marketing tool. For more information on how Shopify uses your personal data, please see here: https://www.shopify.com/legal/privacy.
Disclosure to third parties and third-party access
Without the support of other companies, we would not be able to provide our services in the desired form. To use the services of these companies, it is necessary to some extent to disclose your personal data. Such disclosure occurs in particular to the extent necessary for the fulfillment of the contract you have requested, i.e., for example, to logistics or transport companies that deliver the desired products, or to a manufacturer who is to fulfill your warranty claim.
Disclosure also takes place to selected service providers and only to the extent necessary for the provision of the service. Various third-party service providers are also explicitly mentioned in this privacy policy, e.g., in the sections on marketing. Other examples include IT service providers (such as software solution providers), advertising agencies, and consulting companies.
We use Shopify to power our online store. For more information on how Shopify uses your personal data, please see here: https://www.shopify.com/legal/privacy. We also use Google Analytics to understand how our customers use the website. For more information on how Google uses your personal data, please see here: https://policies.google.com/privacy?hl=de. You can deactivate Google Analytics here: https://tools.google.com/dlpage/gaoptout.
Furthermore, your data may be disclosed, particularly to authorities, legal advisors, or collection agencies, if we are legally obliged to do so or if it is necessary to safeguard our rights, particularly to enforce claims arising from the relationship with you. Data may also be disclosed if another company intends to acquire our company or parts thereof, and such disclosure is necessary for the purpose of conducting due diligence or for the execution of the transaction.
Transfer of personal data abroad
We are entitled to transfer your personal data to third parties abroad if this is necessary for the performance of the data processing operations mentioned in this privacy policy. In doing so, the legal provisions for the disclosure of personal data to third parties will, of course, be complied with.
Retention periods
We store personal data only for as long as it is necessary to carry out the processing described in this privacy policy within the scope of our legitimate interest. For contract data, storage is prescribed by statutory retention obligations. Requirements that oblige us to store data arise from accounting regulations and tax laws. According to these regulations, business communication, concluded contracts, and booking receipts must be kept for up to 10 years. Data will be deleted as soon as there is no longer a retention obligation and no legitimate interest in retaining it.

Cookies
Cookies are information files that your web browser stores on your computer's hard drive or RAM when you visit our website. Cookies are assigned identification numbers that identify your browser and allow the information contained in the cookie to be read.

On our behalf, the provider will use this information to evaluate the use of the website, to compile reports on website activities for us, and to provide other services related to website usage and internet usage for market research and needs-based design of these internet pages. For these processes, we and the providers can be considered joint controllers for data protection purposes to a certain extent.
You have the option to make personalized settings in the cookie banner or to reject the use of cookies. Please note that a cookie will be set for this purpose. Blocking will not affect the use of the online shop. You can reject or deactivate the relevant cookies in your web browser settings (see the "Cookies" section) or make use of the service-specific options described below.
For further processing of data by the respective provider as the (sole) data protection controller, in particular any onward transfer of this information to third parties such as authorities due to national legal provisions, please refer to the respective privacy notices of the provider.
Google Analytics
We use the web analytics service Google Analytics from Google Ireland Limited (Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland) or Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) ("Google").
The described data about the use of the website for the explained processing purposes may be transferred to the servers of Google LLC in the USA. The IP address will be truncated within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission.
Users can prevent the collection of the data generated by the cookie and related to the website usage by the respective user to Google, as well as the processing of this data by Google, by downloading and installing the browser plugin available at the following link:
http://tools.google.com/dlpage/gaoptout?hl=de. Further information on data protection at Google can be found on their homepage.

Our website uses Adobe's Experience Cloud technology to collect information about how users interact with the website and its content. The necessary cookies are set based on our legitimate interest during the first visit to the website to better understand the user behavior of our site visitors and to further develop the website.
The Adobe Experience Cloud technologies currently in use are Adobe Analytics (reporting and analysis of user behavior) and Adobe Target (A/B testing of different website variants to improve user experience). These services collect, process, and store data on user behavior in Adobe data centers in Europe.

A connection between your access to our website and your user account will occur in any case if you log in to the respective network after clicking the link. Online Advertising and Targeting
In General
We use the services of various companies to provide you with interesting online offers. Your user behavior on our website and on the websites of other providers is analyzed to then display personalized online advertising tailored to you.
Most technologies for tracking your user behavior ("tracking") and for targeted advertising ("targeting") work with cookies (see also the section "Cookies"), which allow your browser to be recognized across different websites. Depending on the service provider, it may also be possible for you to be recognized online even when using different end devices (e.g., laptop and smartphone). This may be the case, for example, if you have registered for a service that you use with multiple devices.
In addition to the already mentioned data that arises when visiting websites ("logfile data") and when using cookies and which can reach the companies involved in the advertising networks, the following data, in particular, is included in the selection of the most potentially relevant advertising for you:
-
Information about yourself that you provided when registering for or using a service from advertising partners (e.g., your gender, your age group);
-
User behavior (e.g., search queries, interactions with advertising, types of websites visited, products viewed and purchased, newsletters subscribed to).
We and our service providers use this data to determine whether you belong to the target group we are addressing and take this into account when selecting advertisements. For example, after visiting our site, you may see advertisements for the products you consulted when visiting other pages ("re-targeting"). Depending on the scope of the data, a user profile can also be created that is automatically evaluated, and advertisements are selected according to the information stored in the profile, such as belonging to certain demographic segments or potential interests or behaviors. Such advertisements can be presented to you on various channels, including our website or app (as part of onsite and in-app marketing) as well as advertisements mediated via online advertising networks we use, such as Google.
The data can then be evaluated for the purpose of billing with the service provider and for assessing the effectiveness of advertising measures, in order to better understand the needs of our users and customers and to improve future campaigns. This can also include information that an action (e.g., visiting certain sections of our websites or submitting information) is attributable to a specific advertisement. Furthermore, we receive aggregated reports of advertising activities and information on how users interact with our website and our ads from the service providers.
You can revoke your consent at any time by rejecting or deactivating the relevant cookies in your web browser settings. Further options for blocking advertising can also be found in the information of the respective service provider.
Google Ads
Our website uses the services of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google") for online advertising. Google uses cookies, such as the so-called DoubleClick cookie, which enable your browser to be recognized when visiting other websites. The information generated by the cookies about visiting these websites (including your IP address) is transmitted to a Google server in the USA and stored there (also refer to section 6). Further information on data protection at Google can be found on their homepage.
You can revoke your consent at any time by rejecting or deactivating the relevant cookies in your web browser settings (see section 11). Further options for blocking advertising can be found on Google's Support Homepage.
We use Google Ads Customer Match. This is a function within Google Ads that allows prospects and existing customers to be reached more effectively and addressed in a personalized way in Google Search, the Google Shopping tab, Gmail, YouTube, and the Google ad networks. Google Ads Customer Match is used, in particular, for remarketing, optimizing campaigns, and increasing the conversion rate.
The personalization of Google advertising is based on assignment to a target group and is carried out by Google based on the information from your Google account and on the activities and interests that arise from your use of Google products and with Google advertising partners. As a Google advertising partner, the use of Google Ads Customer Match enables us to address target groups more precisely and ensures, for example, that the advertising displayed via Google Ads is more precisely tailored to the target group-specific interests that result from your use of our shop. Google Ads Customer Match does not require separate cookies for this purpose. Google requires a list of customer data from us to be able to understand whether you are already known to Google as a user. However, no profiles are created or extended in this process. Google also does not receive your actual data (such as email address, phone number), but only so-called hashed codes that were created using one-way encryption. Google compares these hashed codes with its own user database. Google cannot decrypt these codes again unless the corresponding data is already present in its own user database. Consequently, Google does not receive the customer data uploaded during the upload, but can only determine whether the data is already present at Google or not. If the data is not present at Google, the hashed codes created on the basis of the customer data cannot be decrypted again. Otherwise, the data already known to Google and the hashed codes match, and an assignment for the formation of target groups is possible. After the target groups have been created, the uploaded data is deleted.
Use of our Chat Function
When you contact us via chat, your personal data will be processed. The data you provide to us will be processed, e.g., the name of your company, your name, your function, your email address, and your request. In addition, the time of receipt of the request is documented. Mandatory fields are marked with an asterisk (*).
We process this data exclusively to implement your request (e.g., providing information about a product, assisting with contract processing such as product returns, incorporating your feedback into improving our service). For the provision of the chat function, we use a tool from Shopify International Limited, Victoria Buildings, 2nd Floor, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland
Further information on how Shopify uses your personal data can be found here: https://www.shopify.com/legal/privacy.
